About MacMobile Services

Thank you for visiting the MacMobile Services' website. MacMobile Services was established in 1993 by John East to meet the lack of on-site support to Macintosh® computer users. John has over 20 years experience with the Apple Macintosh® platform. MacMobile Services maintains a competitive edge by providing personal attention to it's clients. The business is run through a mobile unit allowing most work to be performed at the client’s residence or place of business. MacMobile Services provides on-site services for your Macintosh® computer bringing it up to Apple® Specifications through Software, Hardware installations and maintenance updates. Complete system diagnostics and Internet setup using the latest software available.

MacMobile Services Terms and Conditions

Data Protection and Authority
MacMobile Services is not liable for loss or corruption of data or your confidential, proprietary, or personal information or removable media. MacMobile Services at its discretion, and as a courtesy to the client may attempt to perform a backup for the client before work is performed.
BEFORE YOU RELEASE YOUR MACINTOSH COMPUTER FOR ANY SERVICE, YOU SHOULD MAKE A BACKUP COPY OF YOUR DATA AND REMOVE FROM YOUR MACINTOSH COMPUTER ANY CONFIDENTIAL, PROPRIETARY, OR PERSONAL INFORMATION AND REMOVABLE MEDIA SUCH AS FLOPPY DISKS, CDS, OR PC CARDS.

If any service involves accessing, using, or transferring data stored on your Macintosh Computer, you represent that you have the legal right to access, copy, or use any such data and to permit MacMobile Services to do so, and authorize any such use by MacMobile Services. You also agree that if any service involves installing software on your Macintosh Computer, you have the legal right to agree to the terms of any applicable software license and authorize MacMobile Services to accept such terms on your behalf in performing the services.
These Terms of Service are governed by the laws of the State of California (without giving effect to its conflict of law provisions). If any provision of these Terms of Service is held to be illegal or unenforceable, that provision will no longer be part of the Terms of Service, and the Terms of Service will be enforceable as though that provision never was a part of them. You should keep copies of these Terms of Service, and any sales receipts or other materials, for your records. MacMobile Services reserves the right to substitute, cancel, or add to any part of the Terms of Service, or end a service at any time without notice.

Troubleshooting and Upgrading

Client agrees to cooperate with MacMobile Services during the period work is being performed.
If the client does not cooperate and/or withholds information that is necessary for MacMobile Services to complete the work put forth, MacMobile Services has the right to discontinue the work and refuse further business with said client.
MacMobile Services can refuse to perform work on a device known to have a preexisting issue and therefore cannot be held liable for damages.

Unless work is performed on your product under warranty or extended service contract without charge, you will pay MacMobile Services the amount shown on the work order. Your payment is due when the product is returned to you, unless otherwise specified by MacMobile Services. Unless specified otherwise, the estimated amount includes all parts, labor, and certain transportation required for the work done on the product plus any applicable tax. MacMobile Services may hold you responsible for the diagnostic fee on the work order, plus any applicable tax, if MacMobile Services inspects your product, provides an estimate for you, and you do not authorize MacMobile Services to undertake the work for the estimated charges. If MacMobile Services determines, while inspecting your product, that repairs are needed due to failures of parts that are neither supplied by Apple
® nor Apple® branded or are needed due to damage caused by abuse, misuse or misapplication, MacMobile Services reserves the right to return the product to you without working on it, and will hold you responsible for the diagnostic fee on the work order, plus any applicable tax.

Warranty
MacMobile Services warrants that the work will be performed in a competent and workmanlike manner for a period of thirty (30) days starting from date client takes possession of product, unless otherwise specified by MacMobile Services. If a problem arises within the previously mentioned time period when work was last performed by MacMobile Services and is determined that MacMobile Services is at fault, MacMobile Services will attempt to correct at no charge to the client. If it's determined that the problem is unrelated, the client will be charged a travel fee for diagnosing the problem plus additional charges to correct the problem.

IF PRODUCT SHOULD BE DAMAGED OR LOST WHILE IN MACMOBILE SERVICE’S CUSTODY, MACMOBILE SERVICE’S LIABILITY WILL BE LIMITED TO THE COST OF THE SERVICE RENDERED OR REPLACEMENT OF THE AFFECTED PRODUCT. SUBJECT TO THE PREVIOUS SENTENCE, MACMOBILE SERVICE’S ENTIRE LIABILITY FOR YOUR DAMAGES FROM ANY CAUSE WHATSOEVER WITH RESPECT TO THE SERVICE OF YOUR PRODUCT, WHETHER DUE TO MACMOBILE SERVICE’S NEGLIGENCE OR TO ANY OTHER REASON, IS LIMITED TO THE AMOUNTS THAT YOU PAY FOR SERVICES. MACMOBILE SERVICES HAS NO LIABILITY WHATSOEVER FOR INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, SUCH AS LOST PROFITS OR REVENUE. MACMOBILE SERVICES ALSO HAS NO LIABILITY FOR LOSS OF OR DAMAGE TO DATA OR SOFTWARE APPLICATIONS. YOUR ONLY REMEDY UNDER THIS SERVICE AGREEMENT IS TO SEEK RECOVERY OF DAMAGES AGAINST MACMOBILE SERVICES IN AN AMOUNT NOT TO EXCEED WHAT YOU HAVE PAID FOR THE SERVICES PERFORMED.



If you have not claimed your product and paid all charges due within sixty (60) days after being notified by MacMobile Services that your product service has been completed, MacMobile Services will consider your product abandoned. MacMobile Services will provide such notice to you at the mailing address you furnished when you authorized service. MacMobile Services may dispose of your product in accordance with applicable provisions of law, and, specifically, may sell your product at a private or public sale without liability to you. MacMobile Services reserves its statutory and any other lawful liens for unpaid charges.

You agree and understand that it is necessary for MacMobile Services to collect, process and use your data in order to perform the service and support obligations under these Terms of Service.

MacMobile Services enforces a zero tolerance policy and therefore has the right to refuse service to anyone except on the basis of race, color, national or ethnic origin, ancestry, age, religion or religious creed, disability or handicap, or gender.

PRIVACY POLICY
MacMobile Services collects client information for the purpose of doing business with the client. MacMobile Services will not provide or sell client’s information to third parties without client’s written consent to do so.
